Förstahandshyresgäst(er) (sökande)

För att få hyra ut sin lägenhet i andra hand krävs samtycke från hyresvärden. Handläggningstiden är cirka fyra veckor från det att en komplett ansökan kommit in till hyresvärden. Andrahandsuthyrning medges för högst ett år per ansökningstillfälle. Avslår hyresvärden ansökan, har hyresgästen möjlighet att hos hyresnämnden ansöka om tillstånd till andrahandsuthyrningen.

Uthyrning i andra hand utan samtycke från hyresvärden eller tillstånd från hyresnämnden kan utgöra grund för uppsägning utan föregående varning. Detsamma gäller om samtycke eller tillstånd grundats på oriktiga uppgifter eller om en hyra som överstiger skälig hyra tas ut mot andrahandshyresgästen. Skälig hyra är samma hyra som hyresgästen själv betalar till sin hyresvärd samt tillägg för möbler, utrustning och andra nyttigheter exempelvis bredband. Tilläggen får högst motsvara hyresgästens egna kostnader och för möblering, högst 15 % av det belopp som förstahandshyresgästen betalar i hyra.

Hyresgästen svarar även under tiden lägenheten är upplåten i andra hand för alla förpliktelser, som åvilar honom eller henne enligt hyresavtalet och hyreslagen. Något hyresförhållande mellan hyresvärden och andrahandshyresgästen uppkommer inte genom hyresvärdens medgivande till andrahandsupplåtelse.

To sublet one’s apartment, consent from the landlord is required. The processing time is approximately four weeks from the date a complete application is submitted to the landlord. Subletting is granted for a maximum of one year per application period. If the landlord rejects the application, the tenant has the opportunity to apply to the Rent Tribunal for permission to sublet.

Subletting without the landlord’s consent or permission from the rent rribunal may constitute grounds for termination without prior warning. The same applies if consent or permission is based on false information or if a rent exceeding the reasonable rent is charged to the subtenant. The reasonable rent is the same rent that the tenant pays to their landlord, plus additions for furniture, equipment, and other amenities such as broadband. The additions must not exceed the tenant’s actual costs and, for furnishings, must not exceed 15% of the amount paid by the primary tenant in rent.

The tenant is also responsible during the period the apartment is sublet for all obligations that arise for him or her according to the lease agreement and the rental law. No tenancy relationship between the landlord and the subtenant arises through the landlord’s consent to subletting.
