To sublet one’s apartment, consent from the landlord is required. The processing time is approximately four weeks from the date a complete application is submitted to the landlord. Subletting is granted for a maximum of one year per application period. If the landlord rejects the application, the tenant has the opportunity to apply to the Rent Tribunal for permission to sublet.
Subletting without the landlord’s consent or permission from the rent rribunal may constitute grounds for termination without prior warning. The same applies if consent or permission is based on false information or if a rent exceeding the reasonable rent is charged to the subtenant. The reasonable rent is the same rent that the tenant pays to their landlord, plus additions for furniture, equipment, and other amenities such as broadband. The additions must not exceed the tenant’s actual costs and, for furnishings, must not exceed 15% of the amount paid by the primary tenant in rent.
The tenant is also responsible during the period the apartment is sublet for all obligations that arise for him or her according to the lease agreement and the rental law. No tenancy relationship between the landlord and the subtenant arises through the landlord’s consent to subletting.
